Terms of Service

1. Agreement to Terms

By accessing or using the Ops Intel platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms constitute a legally binding agreement between you ("User", "you") and Ops Intel ("we", "us", "our"), operated from Newcastle upon Tyne, England.

2. Description of Service

Ops Intel is a business automation SaaS platform providing AI-powered tools including an AI Receptionist, Social Media Scheduler, Lead Prospecting, and Workflow Builder. The Service is provided on a subscription basis.

3. Account Registration

To use the Service you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us promptly of any unauthorised access to your account
  • Take responsibility for all activity that occurs under your account

4. Subscription and Billing

The Service is offered on a free trial and paid subscription basis. By subscribing:

  • You authorise us to charge your payment method on a recurring basis
  • Subscriptions auto-renew unless cancelled before the renewal date
  • All fees are in GBP (£) and are non-refundable except where required by law
  • We reserve the right to change pricing with 30 days' notice

Payment processing is handled by Stripe. Your payment details are governed by Stripe's terms.

5. Acceptable Use

You agree not to use the Service to:

  • Send spam, unsolicited messages, or harassing communications
  • Violate any applicable law or regulation, including anti-spam laws (PECR, CAN-SPAM)
  • Infringe the intellectual property rights of any third party
  • Introduce malware, viruses, or other malicious code
  • Attempt to gain unauthorised access to any part of the Service
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Use the Service to process sensitive personal data without appropriate safeguards

6. Your Data

You retain ownership of all data you input into the Service. By using the Service, you grant us a limited licence to process your data solely to provide the Service. We will not sell your data or use it for purposes other than operating and improving the platform. See our Privacy Policy for full details.

7. Intellectual Property

The Ops Intel platform, including its design, code, trademarks, and content, is owned by Ops Intel. Your subscription grants you a limited, non-exclusive, non-transferable right to access and use the Service for your internal business purposes only.

8. Third-Party Integrations

The Service integrates with third-party services (Stripe, SendGrid, Meta, Google Maps, n8n, Notion). Your use of those integrations is subject to the respective third parties' terms and privacy policies. We are not responsible for the acts or omissions of third-party services.

9. Service Availability

We aim for high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance and will endeavour to provide advance notice. We are not liable for service interruptions beyond our reasonable control.

10. Limitation of Liability

To the maximum extent permitted by law, Ops Intel shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or business arising out of or related to your use of the Service.

Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Ops Intel and its officers, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.

12. Termination

You may cancel your subscription at any time. We may suspend or terminate your account immediately if you breach these Terms. Upon termination, your right to use the Service ceases. We will retain your data for 30 days after termination before deletion.

13. Changes to Terms

We may revise these Terms at any time. Material changes will be notified by email or prominent notice at least 14 days before they take effect. Continued use of the Service after changes constitute acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
